Paris Court Orders TotalEnergies to Include Customer Emissions, Declines to Force Production Cuts

The Paris Judicial Court orders TotalEnergies to amend its corporate vigilance plan to include indirect emissions from customers, known as Scope 3, and gives the company six months to comply.The court declines to order the production cuts and the ban on new fossil projects sought by the City of Paris and four nongovernmental organizations; plaintiffs had demanded a 37% oil cut and a 25% gas cut by 2030.Plaintiffs say TotalEnergies' products produced 342M tonnes of CO2 equivalent in 2024 and that including those emissions is necessary to meet human rights obligations under the 2017 duty of vigilance law.TotalEnergies contends the law covers only its operations and contractors and warns that forced production cuts would shift output to competitors; the Paris public prosecutor cautions against overly broad corporate duties.
