Apple Loses EU Digital Markets Act Appeal as Court Upholds Gatekeeper Duties

The General Court of the European Union upholds the EU designation of Apple as a gatekeeper under the Digital Markets Act and rejects Apple’s argument that its App Stores and iOS should be treated separately. The court obliges Apple to allow rival developers greater access to the App Store and iOS, to host alternative app marketplaces, to give developers more freedom in payments and to enhance interoperability, including provisions that affect iMessage.Apple says the obligations would harm user privacy, security and intellectual property and is pursuing a narrow appeal on interoperability, while the European Commission says the measures are required to protect competition and consumer choice.
